Trial and error

So let me get this straight…
If 12 people say you’re guilty, you go to prison, but if 13 people say you’re guilty, you’re not convicted? How does that make sense?

    Couldn’t the have just picked 12 at random? I’m pretty sure the outcome would have been the same.

    Of course this helps save the appellate process, but still…
